2. Service Description

BringPhotosAlive provides an online service that uses artificial intelligence (AI) to animate still photographs, creating short video clips (“Videos”). The Service is designed to create moving, artistic interpretations of your photos for personal enjoyment and entertainment.

3. Payment and Billing

Our Service operates on a pay-per-video basis.

• Payment is required before the animation process begins.
• All payments are processed securely through our third-party payment processor, Stripe.
• Prices are displayed in USD at the time of purchase.
• We reserve the right to change our pricing at any time, with notice provided on our website. Promotional prices are valid for the time period specified.

4. Delivery and Refunds

We aim to deliver your completed Video via email within 24 hours of successful photo upload and payment. This is a target, and delivery times may vary.

Due to the automated, customized, and digital nature of our Service, all sales are final and non-refundable once a photo has been submitted and processing has begun. 5. Content and Intellectual Property

You retain all ownership rights to the original photos you upload. By using our Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, modify, process, and reproduce your photos for the sole purpose of creating and delivering your requested Video.

6. User Responsibilities and Acceptable Use

You agree to use our Service only for lawful purposes. You must be at least 18 years of age to use this Service. You agree that you will not:

• Upload photos that you do not own or have the legal right and permission to use.
• Upload photos containing nudity, violence, hate speech, or any illegal, harmful, or offensive content.
• Upload photos of minors without the express consent of their legal guardian.
• Use our Service to create deepfakes, misinformation, or other misleading content.
• Attempt to reverse engineer, decompile, or otherwise disrupt our Service or its underlying technology.
• Violate any applicable local, state, national, or international laws or regulations.

7. Service Availability and Disclaimers

We strive to provide a reliable service, but we make no guarantees regarding its performance.

• The quality of the final Video is heavily dependent on the resolution, lighting, and condition of the source photograph. We are not responsible for results from poor-quality images.
• The AI-generated animation is an artistic interpretation and may contain artifacts or inaccuracies.
• We do not guarantee uninterrupted service availability or specific processing times.

8. Limitation of Liability

To the maximum extent permitted by law, BringPhotosAlive shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

We may terminate or suspend your access to our Service at any time, with or without cause and with or without notice, effective immediately. Upon termination, your right to use the Service will cease.
